New York’s laws require property owners and other potentially responsible parties to take reasonable steps to clear ice and remove snow in a timely manner in order to avoid and prevent slip and fall accidents.

In particular, under New York law, New York City Code Section 16-123 specifically requires property owners, lessees, tenants, occupants, or others in charge of any building or lot in the city adjacent to a sidewalk to remove “snow or ice … or other material from the sidewalk and gutter” in the area around the property within 4 hours of the time the snow stops. If the area has snow and ice frozen so hard that it cannot be removed immediately, the owner must spread sand, sawdust or other materials, and then thoroughly clear the sidewalk when the weather allows.

Under New York laws, a property owner who fails to follow these rules may be subject to penalties, fines and receive a ticket from the City.

So there may be multiple persons or entities who could be held responsible in a slip and fall accident. For example, a property owner, a lessee (for example, a business that rents the space), tenants, occupants, or anyone in charge of any building or lot could be held liable in a slip and fall accident in New York City. In addition, depending on the circumstances, a condominium board might be responsible for a New York slip and fall accident if the board has control over the sidewalk and its maintenance.
